Commercial entities under bankruptcy, September 2015

Open Data Albania is researching for entities under bankruptcy in the Republic of Albania. According to legislation on taxes, the tax administration has required from the court to initiate bankruptcy proceedings in the event the taxpayer has passed into the passive status in the NRC since two years ago, has tax liabilities declared as uncollectable, has lost its own equity for at least three consecutive years, or has outstanding obligations to the tax administration for at least 2 years.

According to the Directorate General of Taxation in September 2015, 118 commercial entities were under the bankruptcy process.

The district with more tax entities that have started bankruptcy proceedings is Vlora with 36 entities, or 31% of the total. Meantime other districts are Durres with 27 entities or 23% of total entities under bankruptcy, Elbasan and Gjirokastra with 8%, Tirana with only 8 entities or 7% of total entities under bankruptcy, Shkodra with 4% etc. On the other hand 13 units which are qualified as large taxpayers are under bankruptcy process.

By type of registration of entities, it comes out that 8 entities registered as physical persons and 110 registered as commercial companies SHA or SHPK (Anonymous Company or Company with Limited Liabilities) have gone bankrupt.

Tax Administration for its part does not provide information concerning the name of the administrator or administrators of the company, and the date and registration number of the claim in court. Number of enterprises in bankruptcy indicate the quality of business in the country, but there are some businesses that use bankruptcy as a means to avoid liabilities against third parties who have invested or credited to the company
